Wage theft is what happens when an employer fails to meet mandated minimum
wage and/or overtime laws. Wage theft can also occur when an employer
illegally retains portions of an employee's tipped wages. When this happens,
employers can be called to task through wage theft litigation.
The Bowlin Law Firm has been advocating for victimized employees since 2005. Our experienced team of top-rated Knoxville attorneys can help you secure the wages that are rightly yours.
According to both state and federal law in Tennessee, $7.25 is the minimum hourly wage an employee can be paid. If an employee works more than 40 hours in a week, all overtime hours must be paid at time and a half. Though a federal exemption for employees who regularly earn tips reduces their mandated hourly minimum to $2.13, their actual hourly income must still match or exceed $7.25. If tips-plus-wages do not equal that amount, the employer must make up the difference.
Wage theft laws for salaried workers are more complicated, but the legal team at The Bowlin Law Firm can help you understand your rights as a salaried employee.
