Pursue Justice for Defective or Dangerously Designed Products

In the state of Tennessee, manufacturers and others may be held liable for injuries or deaths resulting from defective or dangerously designed products. These products include everything from cars to medication and consumer goods. Manufacturers of parts and sellers of the defective products may also be held liable, depending on the circumstances.

In order to pursue justice in a product liability lawsuit, you will have to prove that the product was in a defective condition, or that it was unreasonably dangerous, at the time it left the control of the manufacturer. A defective condition includes any mistake or flaw that makes one particular item dangerous. Examples include a car tire that is cracked, cough syrup that is tainted with a poisonous substance, and a swing set with a broken chain.

On the other hand, unreasonably dangerous products are those that are more dangerous than would be expected by an ordinary consumer. Examples of dangerously designed products include sunglasses that do not provide UV protection, electric blankets that combust when turned on high, and cars that are prone to roll over.

What Is the Product Liability Statute of Limitations in Tennessee?

The statute of limitations for a product liability claim is 1 year from the date of the injury. However, you must file the claim within 10 years of the date you first purchased the product for consumption or use, or within 1 year after the product’s expiration date. These exceptions do not apply to injuries suffered by minors. If a child is injured by a defective or dangerous product, he or she must file a claim within 1 year of his or her 18th birthday.

Compensation in a Product Liability Lawsuit

Depending on the circumstances, you may be entitled to compensation for a variety of economic and non-economic damages. Our Knoxville personal injury lawyers will discuss your options for seeking justice against negligent or careless parties.

You may be able to receive a settlement for:

  • Past, present, and future expected medical costs
  • Loss of enjoyment of life
  • Disability
  • Lost wages
  • Pain and suffering
  • Disfigurement
  • Emotional distress
  • Loss of earning capacity
  • Other injury-related expenses

Economic damages include medical bills and lost wages. On the other hand, non-economic damages include emotional distress, pain and suffering, and loss of enjoyment of life. It is important to file a claim as soon as possible after you have been injured by a defective or dangerous product. Our firm will guide you through the process as you seek financial relief.
